Caveats
Some dockets will update here twice. That is because CourtListener and/or PACER have the case duplicated, and downloadable PDF's are scattered across both dockets. Our legal professors are working on a solution.

MEMORANDUM OPINION AND ORDER: The court determines that the Individual Defendant established that Plaintiffs failed to exhaust their administrative remedies, and that no genuine dispute of material fact exists as to Plaintiffs' claims for (1) Fi fth Amendment "due process" violations; (2) Eighth Amendment rights violations; and (3) conspiracy to violate Plaintiffs' Fifth and Eighth Amendment rights. Accordingly, the court grants the Individual Federal Defendants' Motion f or Summary Judgment on Exhaustion of Administrative Remedies (doc. 47 ) and dismisses with prejudice this action for failure to exhaust administrative remedies. The court denies as moot the Individual Defendants' Motion to Dismiss on Qualified Immunity. Judgment will issue by separate document as required by Rule 58 of the Federal Rules of Civil Procedure. ORDER as to Barrett Lancaster Brown: Although the court explained on the record the manner in which it calculated the advisory guidelines during the sentencing hearing in this case on 1/16/2015, the court files this order to reflect the action it took, which is fully reflected in the transcript of the hearing. The court also addresses the issue raised at the end of the hearing regarding the return of Defendant Barrett Brown's ("Defendant") copy of the Declaration of Independence. Thus, notwithstanding the agreement between the parties, the court declines to accept the portion of the Plea Agreement that requires Defendant to forfeit his copy of the Declaration of Independence. Accordingly, the court orders the Government to return Defendant's copy of the Declaration of Independence to his counsel within ten (10) days of the date of this order.
