ORDER as to David Brilhante re 26 MOTION for Leave to File Document Appeal of Out of District Detention Decision and Motion to Stay filed by USA: Both parties emailed the Court's deputy today inquiring about the status of the government's appeal of the decision of a Magistrate Judge in Central District of California ("CDCA MJ") granting Brilhante's release on bond pending trial. In their bail appeal, the government indicated that (1) Brilhante had been granted bail on September 5, 2025; and (2) pursuant to the CDCA MJ's order granting bail, "absent further action, the release will be effectuated December 10, 2025," i.e., the same day the government filed its appeal. Notably, the government failed to explain why it had waited until December 10, 2025 to appeal the CDCA MJ's September 5 bail decision. Furthermore, despite the seeming time-sensitivity of this request, the government failed to respond to an email from the Court's deputy on December 10 at 4:44 p.m. inquiring about the status of Brilhante's and his co-defendants' cases. Thus, the Court did not know whether Brilhante was still in custody after December 10 and whether the Court needed to address the government's appeal of the CDCA MJ's bail decision. However, just today, the government emailed the Court's deputy that Brilhante is still in custody, that a "bond hearing" is set to occur tomorrow, December 18, in CDCA, and that the government wants to know if the Court "intends to issue a stay of the release order." At the same time, Brilhante's counsel contacted chambers today requesting that he be given an opportunity to respond to the government's bail appeal, even though it was filed a week ago. Brilhante's counsel, however, has not entered their appearance in this case, nor have they sought pro hac vice admission to this court (since they are not admitted to practice in this district).Accordingly, the defense has until December 18, 2025 at 5:30 p.m. (EST) to seek pro hac vice admission, enter their appearances, and file their response to the government's bail appeal. In the meantime, the Court will consider whether to issue an order staying Brilhante's release to allow the Court sufficient time to consider the government's bail appeal and Brilhante's response.
