ORDER: The Court is in receipt of the 107 joint letter regarding civil commitment proceedings as to defendant Angel Almeida. The Court finds that defendant is not competent and non-restorable pursuant to 18 U.S.C. § 4241(d). It is ordered that the Bureau of Prisons continue hospitalizing the defendant for treatment in a suitable facility for a period not to exceed 45 days from the date of this order, as is necessary to "permit the Government to decide whether to seek" the defendant's "civil commitment." United States v. Woods, --- F.4th ----, 2026 WL 303452, at *4 (2d Cir. Feb. 5, 2026) (citing United States v. Magassouba, 544 F.3d 387, 405 n.9 (2d Cir. 2008)); 18 U.S.C. § 4241(d)(2)(B). In light of the parties' agreement, the Bureau of Prisons may prepare a psychological report pursuant to 18 U.S.C. § 4247(b) and (c) that includes (1) defendant's history and present symptoms; (2) a description of the psychiatric, psychological, and medical tests that were employed and their results; (3) the examiner's findings; and (4) the examiner's opinions as to diagnosis and prognosis and whether defendant is suffering from a mental disease or defect as a result of which his release would create a substantial risk of bodily injury to another person or serious damage to the property of another. The report may be filed with the Court, with copies to counsel for defendant and the government by 4/13/2026. If the examiner's report finds that defendant meets the criteria for commitment pursuant to 18 U.S.C. § 4246, the Bureau of Prisons may file it, along with the Wardens Certificate of Dangerousness, to the Clerk of the Court for the District in which defendant is confined and notify this Court when such Certificate has been filed.
