Judge Richard G. Stearns: ELECTRONIC ORDER entered denying [60] Motion for Partial Summary Judgment; denying [72] Motion to Dismiss. Because TPS status for nationals of Haiti is currently extended through February 3, 2026, the court finds the portion of the case directed to the allegedly unlawful vacatur and termination of Haiti's TPS designation moot. Judge Chen in the Northern District of California has ruled in plaintiffs' favor concerning the Secretary's vacatur and termination of Venezuela's TPS designation. See Noem v. Natl TPS All., --- F. Supp. 3d ----, 2025 WL 2578045 (N.D. Cal. Sept. 5, 2025). His decision is currently on appeal before the Ninth Circuit Court of Appeals and is expected to reach the Supreme Court in due course. Because that case is farther advanced than this one, and because the Supreme Court has stayed Judge Chen's order pending disposition of the appeals process, see Natl TPS All., --- S. Ct. ----, 2025 WL 2812732 (Oct. 3, 2025), there is little to be gained by this court issuing any alternative ruling which may simply confuse proceedings well on track to a resolution of the underlying merits issue.
