Caveats

Some dockets will update here twice. That is because CourtListener and/or PACER have the case duplicated, and downloadable PDF's are scattered across both dockets. Maybe there will be a fix for it eventually.

Entry #79 in Flynn v. Wellman, 8:23-cv-02501

Filed under stewanon on Mar 10, 2025 [See all in Flynn v. Wellman]

ENDORSED ORDER: The Court denies Defendant's motion to reopen the case. (Doc. # 74). The Court lacks jurisdiction to re-open the case. Once Plaintiff filed its notice of voluntary dismissal pursuant to Rule 41(a)(1)(A)(i) (Doc. # 71), the case was immediately dismissed and no court order was necessary to dismiss the case. See Absolute Activist Value Master Fund Ltd. v. Devine, 998 F.3d 1258, 1265 (11th Cir. 2021) ("[V]oluntary dismissal under Rule 41(a)(1)(A)(i) is effective immediately upon filing, and thus no further court order is necessary to effectuate the dismissal." (internal quotations omitted)). Upon Plaintiff's notice of voluntary dismissal, "the district court [was] immediately deprived of jurisdiction over the merits of the case." Id. However, the Court determines that it possesses limited jurisdiction over the case to adjudicate Defendant's motion for attorneys' fees. "Even when a voluntary dismissal disposes of an entire action, district courts retain jurisdiction to consider at least five different types of collateral issues: costs, fees, contempt sanctions, Rule 11 sanctions, and motions to confirm arbitral awards." Absolute Activist, 998 F.3d at 1266. Therefore, the Court directs Plaintiff to file its response to Defendant's motion for attorneys' fees by March 24, 2025. Signed by Judge Virginia M. Hernandez Covington on 3/10/2025. (RAS) (Entered: 03/10/2025) [Read More]
